Berry was said to have a condition a specialized shoe could fix.

He hasn’t undergone surgery, even though if he had done it off the bat, he could have returned by playoff time.

He has been described as “literally day to day” for 70 days.

He could have been placed on IR and brought back, the team has instead opted to use a roster spot on him.

What is going on?

He has a contract. If there were legal ways for the team to sever it, they would have probably explored them already. They're stuck with him.

Possibly, too soon and it be a PR nightmare. His people know this and are milking the shit out of it.

I'm certainly no legal expert, but if there's a surgery or treatment that could expedite his return to football and he's avoiding it then I'd think there could be a possibility of breach of contract. A contract is a two way street with responsibilities for both parties. It already seems very likely that the team has cleared Berry for a return and he's telling them no. He can't just continue to avoid playing and also expect to continue getting paid.

Yes, it'd be a PR nightmare now. I could be wrong, bit I don't think they'd be in violation of HIPAA by releasing details about them clearing him for football activities and him still refusing to play. If we're going through this same bullshit a year from now I think this has to be considered, regardless of the backlash. Fan opinion of Berry is already starting to shift. The guy who called him out on the radio went too far for most people, but the anger towards Berry is only going to grow the longer he doesn't play and doesn't say a peep.

FWIW we can’t do anything until the season is over, but here’s the numbers for a June 1st cut designation:

2019: $6.95 million dead money | $9.55 million saved
2020: $4 million dead money | $9.5 million saved
2021: $4 million dead money | $12 million saved
2022: $0 dead money | $14 million saved

Keeping Berry close to returning gives people hope and keeps them from complaining about it. "Don't worry, Berry is close to coming back he'll fix everything".

I think they did the same thing with Justin Houston a couple of years ago with his bum knee.

Im a big Eric Berry fan but whats going on with him is effin nonsense.
Just what the hell are they doing saying he is day to day for the last 2 months when he hasnt practised or done anything.
If hes been cleared to play but refuses the Veach should damn well suspend him.
And Hunt should be all over Veach to take action.
If he isnt cleared to play then he should of been put on IR or if its a permanent injury then work out an injury settlement and be done with him.
Berry works for the Chiefs and should not be dictating to them if and when he actually plays football.

I assume he only has a couple, chemically enhanced, games in him and both sides are saving him for a playoff run.

At the end of the year it about has to be, "get the surgery or get cut". Unless he balls out in the playoffs, I'd probably just cut him if the surgery really involves cutting the Achilles. I wouldn't even care if he balled out and they still cut him. At some point, it's business.
