I’ve got a few updates to anyone interested…
So the defendant, Alicia finally got served after ducking it for months. She hired an attorney, and things progressed until I recognized the name of her attorney. I’d spoken to this guy discussing everything about the case in a 15 minute phone conversation. I realized during our conversation this lawyer was NOT for me.
But I mention this to the attorney I did actually hire and he recommends having her attorney removed due to a potential conflict of interest. Several filings later and a quick zoom call hearing later, her attorney is removed. It was pretty embarrassing. Her attorney has a lousy reputation, is getting up there in years and according to my attorney, the guy could be disbarred. I probably did her a favor in getting that jackass removed.
But nevertheless, Alicia was given notice to find other representation within 30 days or she would be on her own. Several more filings with the same judge, mind you…. As an aside, the judge seems like a smart cookie based on my zoom call where I’m getting cross examined by this dipshit lawyer she hired and it was easy to tell the judge was exasperated by this old man pretending to be a lawyer.
So notice was given that she was to be deposed next week, on the 23rd. I received this notice about two weeks ago from my attorney.
Looks like she’s representing herself.
This is where it gets good.
My lawyer reached out to me a couple days ago stating that now Alicia is alleging she had an appointment with MY attorney in September of 2022, and she’s filed a motion for him to be removed as my attorney due to conflict of interest. Unreal. Just for context, in September of 2022, I knew about her wrong doings, but I was still in the probate state with a different attorney handling dad’s estate. I hadn’t even moved things out his house in September of 2022 and I was handling Alicia’s shit with law enforcement.
Well, I’m just gonna copy and paste my attorney’s reply to her filing of him being removed. I can only imagine the smile he must’ve had from ear to ear as he wrote it and then the hopefully horrified look on her face as she read it:
“Alicia
I have your motion and I am giving you this opportunity to withdraw it. You indicated that I saw you in September 2022. Of all the times you could’ve suggested that I saw you, you picked September 2022. First of all, I suspect that’s before the controversy arose, secondly we have no record of you coming in anytime in 2022, but without regard to that, it would’ve been nearly impossible for you to see me in September 2022; in fact, it would highly unlikely for me to see you from about June 2022 through December 2022 as I was gravely ill during that time. I was hospitalized and not able to take appointments for a significant period of time. On top of that medical issue going, my office suffered a huge flood and we were closed for a number of weeks after that.
Thus, you either have me mixed up with someone else or you made this up. I assume the former and doubt the latter. I will give you one week to withdraw the motion, but if you do not, I will assume the latter and file a response and ask for attorney fees and costs. Obviously, if you have anything that indicates that I am mistaken, let me know.
Incidentally, the Court would have records of my absence, because I had to write all the judges a letter to advise of my unavailability.
I await your response.”
Is that something ****ing beautiful, or what? He goes out of his way to just call her a total ****ing liar and presents it into something gleefully satisfying.
At any rate, this experience has been pretty terrible, but this made me laugh. This woman is wearing clown pants and stopping at nothing to not be held accountable. At this point, I kinda wish I was asking for more in punitive damages, but I’m not greedy and that’s not what this has been about. But man…. The thoughts I’ve had if I could have even five minutes alone with this ****…
