This guy is a effing idiot to get himself in this situation. But idiots who are equating assault against a family or household member by impeding their breathing or circulation to attempted murder are also dumb as hell. There are sooo many different meanings to what this charge can actually mean. In all my experience with the law, I have personally never seen this get moved to an attempted murder charge. And with his money and attorneys, no way it will. Still dumb as shit though, and disappointing.
