Hulk Hogan -- $115 MILLION VICTORY ... In Gawker Sex Tape Case

Florida Jury Hands Hulk Hogan a $115 Million Victory in the Gawker Sex Tape Trial

Round one in the Hulk Hogan/Gakwer sex tape trial goes to the wrestler: A Florida jury found decisively in his favor, and says the Web site owes him at least $115 million in damages.

The jury will likely increase the award next week, when it plans to announce punitive damages in the case, which stems from Gawker’s 2012 publication of an excerpt of a sex tape featuring Hogan.

This is the worst-case scenario that Gawker Media owner Nick Denton had sketched out last summer, when the case was first supposed to go to trial.

Denton and his legal team ave said, over and over, that they assumed they would lose the first round of the privacy case, and would then have to appeal it. But they were hoping that damages would be much less than the $100 million that Terry Bollea – the wrestler who performs as Hogan – was seeking.

The prospect of a giant award was one of the reasons Denton sold a stake in his company to Columbus Nova Technology Partners earlier this year — the first time he has ever taken outside investment.

HAHAHAHAHAHA!!!!!!

Gawker, and more specifically AJ Daulerio, absolutely deserved this.

Daulerio's deposition perfectly encapsulated what a smug ****stain that guy is. They probably should've been shut down a year or so ago when they outed the poor bastard from Conde Nast.

They're mean spirited and as biased as it comes. They'd have sat on that tape if it wasn't an opportunity to make fun of someone a pack of eastern elitist shitheads look down on. They got a chance to knock the trailer park crowd down a peg or two and they'll take it every time.

**** Gawker, **** Daulerio and good for the jury for doing what's right here. If there's truly a right to privacy (funny enough, I consider that arguable), then it was violated here.

Good for Terry. That was some shit.

Weird how no one is complaining about the compensation. Yet Erin Andrews gets half of that and it's BS to so many people.

People are siding with the HULKSTER, BROTHER! simply because the ****ing hate Gawker.

If Erin Andrews was suing Gawker, she'd be a hero. **** Gawker, in short.

This is why I came to this thread, actually. I think $115m is an insane amount of money for something like this.

Florida is weird when it comes to appeals. Gawker would have to front $50 million into escrow or else hogan can collect the damages before appeal. Double edged sword. Gawker is screwed either way. good **** them.

$115 million? No.

But $75 million or more? Yeah, I do.

It's going to be a procedural appeal rather than any kind of Constitutional one (unless they really try to push it that far). The appeals court isn't going to hear a Constitutional appeal. What they'll look at is whether or not all evidence was rightly/wrongly excluded or omitted. Evidently Gawker believes a key witness was inappropriately excluded.

Appellate courts give MASSIVE latitude to trial level judges when it comes to evidentiary matters. So I think it's unlikely they'll rule that the exclusion was even inappropriate. Admittedly, I can't speak terribly strongly to it because I don't know why the witness was excluded or what he/she would've testified to.

Now even if they clear that hurdle, I don't think the verdict will be overturned because I believe the appellate court will call it harmless error. I don't know much about that witness but I do know that AJ Daulerio put forward the single worst deposition I've ever seen, he was nearly as bad as a witness and a complete tool during the trial. Daulerio absolutely massacred Gawker through his arrogance. I think there's a very good chance that an appellate court will look at all the evidence and decide that Gawker was drawing dead due to the rest of the evidence adduced.

As for their First Amendment article...it's just absolute bullshit. There is no way on this earth that a sex tape that was surruptitiously recorded without the consent of the parties and released for profit will be considered protected speech. Even getting to speech is a bridge too far, IMO, but even if they get there, it won't be considered protected.

Like I said, if there's a right to privacy, this absolutely violates it.

I think this one stands, at least to the extent needed to sink Gawker.

My issue is the Defendants.

Gawker media actively and knowingly invaded Hogan's privacy by publishing that video both to embarrass him (as their internal memoranda established) and to profit.

Gawker was the correct Defendant in this case.

In the Andrews case, I still don't believe the Hotel committed actionable misconduct. I think there's an argument, but I don't think it's terribly compelling. There's just no foreseeability there and thus no proximate cause.

Hogan went after the right guys; Andrews went after the deepest pockets. That's the only objection I have.

So that's how they retire the undertaker

mcaj22 03-21-2016 10:37 PM

there is going to be some sort of faction interference in Shane vs Taker but I can't figure out what wrestlers are going to side with who

I think it might be some Attitude Era vs WWE. I'd love for it to be the Bullet Club to come down and help Shane that would be huge. But I think like old Raw guys are going to help Taker. (Kane, Big Show, Jericho?, Mark Henry, maybe some other surprise oldies)

chiefscafan 03-21-2016 10:40 PM

So who sides with shane

mcaj22 03-21-2016 10:51 PM

I have no idea but its clear they might re-hash the WWF vs WCW storyline when Shane bought WCW and made his own team. Just theres no WCW so the faction he puts together might be of todays new talent vs the attitude era guys

chiefscafan 03-21-2016 11:32 PM

Hmm maybe should bring back cm punk like I said before

I would love Anderson and Gallows to make their first appearance but I don't know how the crowd would react. The WM crowd tends to be fairly smarky so they would probably know exactly who it is. From a physical standpoint, Gallows is a big dude that can manhandle Taker if he interferes. The other new signees are all going to NXT (Nakamura, Aries, etc.)

well we all know HBK, the Rock, Stone Cold will have a role in WM.

now I know the Rock will doing something with his cousin Roman Reigns to put him over, so I'd imagine maybe HBK is involved in helping Taker.

The Rock has to do something at WM that isn't a match because of his Hollywood insurance restrictions.

What else are they going to do for him have him come out and cut a 20 minute promo of his favorite phrases and leave for no reason like they do on RAW?

He's going to have a role and I can't think of any other WM role for him other than to help his family and put Roman over again.

Or Rock gets in ring with Roman and Roman beats the shit out of him which would accomplish his much-needed heel turn.

I look it as a win win for these reasons:

1) If WM is good to great, then yay it was a good show.
2) If WM is mediocre to bad as we expect, the Raw the night after will be PHUQQING AMAZING with the crowd projectile shitting on every single thing that happens.

Either way, entertainment will be had.

You may have trouble finding the full match. I have NJPWs version of the network for like 9 bucks a month. It's worth it if you want a shitload of good content. Every show they do goes on the streaming service.
