That's what the officer told him when he went in and talked to him. A threat could charged as 3rd degree assault. (according to a friend of mine working when the officer went in to talk to him) Now I didn't want to bring charges against him originally- I just wanted everything documented if something happened.

Personally, I wouldn't want anything to do with a guy like that. Somebody wants to issue threats, they need to be taken seriously, and they deserve to have it on their record. It's the only thing they understand.

Assault and battery can be more severe if the suspect is of robust size and strength against the victim, ie....mentally/disabled, elderly victims.
