Here's what a super senior level music attorney friend of mine had to say about the Zeppelin ruling:
Larry Ferrara certainly made a difference, as well as this judge standing firm by allowing the jury to consider only what was registered in the Copyright Office and not hear the recording. His jury instruction was also crucial, telling them essentially that the chord changes were not subject to copyright protection. If this had been the judge in the Blurred Lines case, and if Ferrara had been able to testify for the defense, I have no doubt the result there would have been far different. |
