More likely to go with failure to adequately protect against violence in the work place under a knew or should have known umbrella with the employer being liable for the resulting environment.

I have done manual labor, and had shitty bosses. That is why I went to school, so I wouldn't have to lose my self-respect working for an asshole that yells all the time.
